TERMS OF SERVICE

The Terms of Service are, simply put, the rules you agree to follow when joining the species. While many are common sense, it is always best practice to familiarise yourself with them when joining a species.

Purchasing or owning a Sweetical or adopts of this universe binds you to these terms of service. While this sheet should be referred to as the main set of rules for the species, please remember that if the creator of the design is not ScarletDestiney then the TOS of the artist in question should be followed as well.

• The creators may use any original artwork/designs related to the Sweeticals for promotional purposes. However, this does not retract your ownership claims to your adopted design.
• The target audience of the Sweeticals community is older teens (18+) and young adults. Members found to be exploiting loopholes within our rules and TOS in order to commit malicious acts will be banned from the community.
• Sweeticals are an ever-growing and developing species that may be subject to change at the discretion of the creators. By owning a Sweetical/participating in our community, you agree to these terms.

GENERAL ETIQUETTE

• You must be 18+ to participate in the server, no exceptions. It will be an immediate ban/blacklist if you are caught lying.
• Be respectful to everyone. If you don't have something positive or constructive to say it is best kept to yourself.
• Passing off traced art as your own is a bannable offense. If found out that you are tracing art in the community, and or submitting traced art for SB and events, you will be banned/blacklisted from the species.
• Do not harass other members, doing so could get you kicked/banned from the server.
• In order to create a Sweetical/Minical, you will need a MYO ticket. Creating Sweetical/Minical for use in the community without MYO tickets may result in a ban/blacklist.
• When selling, trading or swapping Sweeticals, always use the Ownership Transfer Center to finalize it. Transfers made without official transfer proof will not be accepted as final.

PAYMENT PROCESS

• All sales are final and are paid through paypal only! (USD)
• Individuals using paypal to purchase items within our community are assumed to be 18 years of age or older.
• The artist reserves the right to refuse a service or an adopt sale to anyone at their own discretion.

AUCTION/SET PRICE

• Payment must be made within 24 hours after auction ends unless stated otherwise.
• Unwatermarked images will be sent once payment is received.
• You may resell the design only for the price you've purchased unless it comes with extra commissioned artwork that you have paid for.

OTA AND OTHER ADOPTS

• Offers should be posted in the proper channels on Discord or TH threads.From there the owner may decide to note you to further conduct business and reach.
• Unwatermarked images will be sent once the agreement is fulfilled.
• You may not resell for any monetary gain unless you have paid for commissioned work. Otherwise, You can only make trades for other characters or gift them.

RAFFLE/FREE ADOPTS

• Free Designs: designs in which no payment, trade, or art is involved. Unwatermarked images will be sent once the agreement is fulfilled.
• You may not resell for any monetary gain unless you have paid for commissioned work. Otherwise, you can only make trades for other characters or gifts.
• If you obtain a Sweetical through a free design, whether it's from a raffle or other official means, you are not allowed to alter its appeared gender. Designs that come with predetermined pronouns or identities must maintain their original physical appearance. However, you can make adjustments to clothes and accessories. If a design lacks gender information in its flavor text, the owner can interpret it, but the body type must remain unaltered. This rule applies to all free designs from July 29, 2021, onward, excluding those made before this update. Colors and traits are also non-editable.
• Failure to comply with payment rules will have their claim on the adopt revoked. You will then be warned, and or blacklisted.
• Retracted or hidden bidding comments will receive one warning.
• Repeated offenses result in a blacklist.
• If there are any chargebacks on sold Sweetical or in-universe designs, your rights to the design will be revoked and you will be blacklisted from future purchases of our species and from our species events. The design can then be put back up for sale.

CO-OWNERSHIP

• Co-ownership of Official Sweetical designs are allowed.
• You are not allowed to co-own a MYO.
• Please make sure to update ScarletDestiney of the ownership on the masterlist page when co-owning.
• Apart from the payment, the mods do not want to be involved in difficulties between the two parties.
• No more than two people can co-own one character.
• The design can only be altered if both owners agree.
• If partial ownership of a design is relinquished, you may only sell the design for the amount that you paid for. I.e. if you only paid for half the price of the design, you can only resell it for that price. You may sell the design back at full price if you've paid the other owner for the other half of the design.

TRADES, RESELLS, AND VOUCHERS

• There is a 30 day cooldown of trades or resells of a Sweetical starting from the date that it's obtained.
• When notifying a mod of trade and resell, with or without voucher, please submit documentation showing ownership, what you paid/received for the character, and what you are reselling/trading/etc it for.

Resell:

• You may resell the design only for the price you've purchased unless it comes with extra commissioned artwork that you have paid for.
• Personal art may not be included towards the resale price. Only commissioned works may be included.
• You may not resell for any monetary gain unless you have paid for commissioned work. Otherwise, You can only make trades for other characters or gift them.

Trade

• Once a Sweetical design is traded, it can no longer be put up for resale.
• You may not resell for any monetary gain unless you have paid for commissioned work.
• The monetary value of that traded character would then be the value of the commissioned works.

Voucher:

• If you wish to put up a voucher for your sweetical, the value of the items/services must be equivalent or less than the monetary value of the Sweetical.
• The monetary value is the amount that you have paid for the design.
• Users can take partial resells (if they have paid for their design) and ask for other items/services.
• Items/services can only consist of specified art, MYO slots, characters, and partial resale.
• Please note that by accepting art for a trade or voucher, you are also accepting the risk of that artwork not being completed. We are not responsible for any uncompleted services.
• When offering an MYO as a voucher, it counts as an item/good rather than as monetary value.
• Do not claim ownership of the Sweeticals (or adopts in the same universe) closed species, the lore, the original artwork(s). Please make sure to give the proper credit:

• To give credit on dA @mention ScarletDestiney as the creator of the species. If another artist was responsible for the design, credit them as well.

• To give credit on TH, list ScarletDestiney as the creator of the species. If the design was a collaboration, please list the other designers as well. If another artist was responsible for the design, credit them as well.

DESIGN

• Sweetical references should clearly and cleanly display traits and accurately portray the proportions of the character in a way that reflects your art skills.
• What will not be accepted:
• Reference sheets deemed as being too sketchy
• Reference sheets with incorrectly drawn traits
• Low quality reference sheets that do not clearly display traits
• Reference sheets without Sweeticalware
• Reference sheets that were clearly drawn as a joke
• Reference sheets that include existing brands. (Knock-offs are fine)
• Because Sweetical designs are based on specific sweets, you may not alter their design in a way that makes them unrecognizable from the original.
• Anything that involves a physical change of your Sweetical (traits, colors, scars, etc) can only be done with the purchase of an item. This rule applies to the traits within a rarity as well. For example: A MYO Sweetical with a fork-staff sweeticalware cannot be revamped to have a spoon-staff instead.

MYO DESIGNS

• You are only allowed to make your own Sweetical with a Sweetical MYO ticket.
• All Sweeticals need a dessert motive to their design (they need to resemble the actual sweet/drink that they are).
• All MYO submissions must be reviewed by ScarletDestiney or an Official Mod to be made official.
• For vague sweets, we tend to assume it is the standard type (for us, America), so if there are cultural specifications, they can also be considered a different food! (Ex. Italian Ice Cream VS Japanese Ice Cream)
• Each owner can change the sweet of their MYO slot up to THREE TIMES. This does not include the first sweet chosen for the slot. The amount of changes DO NOT carry over after the slot has been transferred.

OFFICIAL DESIGNS

• You may not alter the colors of an official design that you purchased.
• Design alterations you are allowed to make:
• Clothing/Accessories
• Hair style/length
• Appeared Gender
• Any major design changes must be checked through by ScarletDestiney.

CUSTOM DESIGNS

• Custom designs follow the same rules as MYO designs. Please review the above rules to know what you may or may not do with a custom.

GUEST ART

• All Sweeticals and in-universe species guest adopts are subjected to follow this TOS's design rules.
• Trait changes on guest artist purchased designs must be confirmed by Scarlet Destiney once changes are accepted, the owner must notify the designer of the alteration.
• Make sure the GA designer allows edits on their designs! Look for whether the GA design follows Official Design/MYO Design rules in adopt description!
• All guest adopts must be reviewed by ScarletDestiney to be made official.

VOIDING DESIGNS

• When a Sweetical design is "voided", they will no longer be acknowledged as a design or character of our community. These designs are no longer eligible for participation within our community nor its events.
• Voided designs must have all traits involving the species be removed (sweeticalware, mutations etc.) until they are a generic kemonomimi or human. Once the character has been redesigned, it will need to go through an approval process by the creators where they will acknowledge the character no longer has relations to the species. The characters will not be considered "voided" until the new design has been approved.
• All voided characters will remain in our masterlist log with the updated reference sheet.
• Sweetical designs made by the creators and guest artists are not allowed to be voided. This rule may be waived at the discretion of the creators.
• MYO designs must have explicit permission from the designer to have the design voided. Proof must be shown upon request.
• Once a design is voided, the Sweetical design can no longer be traded, vouchered, gifted, sold, raffled, or transferred.
• Designs may also not be traded, vouchered, gifted, sold, raffled, or transferred through the Sweetical mod team for use in the Sweetical community after they have been voided.
• In order to reverse this decision, a Sweetical MYO ticket is required.
• You can send your updated reference sheets to either the Sweeticals Group via notes, or ScarletDestiney on discord.

PRIVATE EXCHANGES

• ScarletDestiney is not responsible for any private transactions or exchanges between members. Members should always be wary of whom they do business/exchanges with. As a general rule we encourage everyone to keep up communication with whomever they are conducting business/exchanges with especially in regards to the compensation/exchange of goods and services in order to avoid any possible misunderstandings. Please be careful when accepting commissions, art trades, and other offers. It's always good to know who you are accepting from and what their track record is like. Furthermore, within our own community we have documents publicly available listing individuals who have warnings or have been banned from our community and server (see: BLACKLIST)

SIMILAR DESIGNS TO SWEETICALS

• Please don't create a CS or designs similar to Sweeticals. I understand that magical, sweet-based, humanoid beings aren't original nor am I trying to copyright it, however I feel as though the concept itself behind my CS is unique enough to where I would know if someone is deliberately going out of their way to make a Sweetical, and that would make me very uncomfortable and sad. I can be very understanding and easy to work with, I will however blacklist anyone who is rude about the concept of my CS. I have no problem explaining my CS to newcomers, but rudely asking why they are a CS with other added remarks will result in you being blacklisted.
